These Terms of Service ("Terms") govern your access to and use of Gustball, including the game, website, online services, community features, and related content provided by Gustball ("we," "us," or "our").

By accessing or using the game or related services, you agree to these Terms. If you do not agree, do not use the game or services.

1. Eligibility

You must be old enough to use online services in your country or have permission from a parent or legal guardian. By using the game, you confirm that you meet these requirements.

2. Accounts

Some features may require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep your account information up to date.

3. User Content

Gustball allows users to create, upload, publish, and share content, including custom levels, comments, usernames, screenshots, profile information, and other materials ("User Content").

You retain ownership of your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, distribute, publicly display, and otherwise use your User Content as necessary to operate, maintain, improve, promote, and provide Gustball and its related services.

You are responsible for your User Content and must not upload, publish, or share content that is illegal, infringing, harmful, abusive, harassing, hateful, sexually explicit, deceptive, malicious, or otherwise inappropriate.

Users may not upload levels or content containing malware, attempts to exploit the game or services, copyrighted material without permission, or content intended to disrupt the experience of other players.

To preserve community content and gameplay functionality, published levels and other community contributions may remain available to players after an account is deleted or otherwise terminated. In such cases, personal account information associated with the deleted account will be removed or anonymized where reasonably practical.

4. Community Rules

You agree not to harass, threaten, impersonate, or abuse other users, spam community systems, exploit bugs, cheat, attempt unauthorized access to accounts or services, upload malicious content, or otherwise interfere with the operation of Gustball.

We may remove content, restrict access, suspend accounts, or permanently ban users who violate these Terms, our community standards, or applicable laws.

5. Purchases and Platform Terms

Purchases may be handled by third-party platforms such as app stores, game stores, or payment providers. Those purchases are also subject to the terms and refund policies of the applicable platform.

6. License to Use the Game

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the game for personal, non-commercial entertainment purposes.

You may not copy, modify, distribute, sell, reverse engineer, or create derivative works from the game except as allowed by law or expressly permitted by us.

7. Online Services

Certain features of Gustball require an internet connection and an active account. Community levels, cloud saves, leaderboards, multiplayer features, and other online functionality may be unavailable during maintenance periods, outages, updates, or other interruptions.

We reserve the right to modify, suspend, or discontinue any online feature or service at any time without liability.

8. Moderation and Enforcement

We may review, moderate, remove, or restrict access to User Content or accounts at our discretion, including when we believe content or behavior violates these Terms, harms other users, or creates legal, security, or operational risk.

9. Account Suspension and Bans

We reserve the right to suspend, restrict, or permanently terminate accounts that violate these Terms, engage in cheating, abuse community systems, exploit bugs, attempt unauthorized access to services, or otherwise harm Gustball, its services, or its users.

Serious or repeated violations may result in permanent loss of access to online features, community content, and account-related services.

10. Privacy

Your use of the game and services is also governed by our Privacy Policy, which explains how we collect, use, and protect information.

11. Disclaimers

The game and services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the game will be error-free, secure, uninterrupted, or compatible with every device or platform.

12. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or other intangible losses arising from your use of the game or services.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Continued use of the game or services after changes become effective means you accept the updated Terms.

14. Termination

You may stop using the game and services at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the game or services.
